Wills and Estates

Wills and Estates Lawyers in Auburn and Western Sydney

A properly prepared will gives your family certainty when they need it most. We help you plan ahead, and we guide families through probate and estate disputes with care and clear advice.

Our Approach

Planning Ahead and Looking After Your Family

Losing someone you love is hard enough without uncertainty about their estate. We prepare wills, powers of attorney and enduring guardianship appointments that reflect your wishes, and we help executors and families deal with an estate step by step.

We act at every stage, from planning your will through to obtaining probate, administering the estate and resolving disputes, before the courts and bodies that deal with wills and estates in New South Wales:

  • Supreme Court of NSW: applications for probate and letters of administration, family provision claims, and disputes about wills and estates.
  • NSW Civil and Administrative Tribunal (NCAT) Guardianship Division: financial management and guardianship applications, and reviews of enduring powers of attorney and enduring guardian appointments.
  • NSW Trustee and Guardian: dealing with estates and financial management where NSW Trustee and Guardian is involved.
  • Wills, Powers of Attorney and Enduring Guardianship: preparing and properly witnessing your documents so they are valid and reflect your wishes.

Where an estate dispute proceeds to a hearing, we work closely with experienced barristers where needed and stay involved in your matter from start to finish.

Strict time limits apply. A family provision claim must generally be made within 12 months of the date of death, so please contact us promptly if you are thinking of challenging, or defending, a will.

You can speak with Irfan in English, Hindi, Urdu or Gujarati.

Good to Know

Key Things to Know

Signing a Valid Will

In NSW a will must be in writing and signed in front of 2 witnesses who are present at the same time and who both sign the will.

Marriage Cancels a Will

Getting married generally revokes an existing will unless it was made in contemplation of the marriage. Divorce revokes gifts to a former spouse.

12 Months for Family Provision

A family provision claim must be made within 12 months of the date of death, unless the Court allows more time on sufficient cause being shown.

Probate After 6 Months

If an application for probate is filed more than 6 months after the date of death, the Court requires an explanation for the delay.
